SEPARATE PROPERTY
property considered to be owned by one spouse prior to marriage, which in most states in not up for distribution upon divorce.
Property not considered part of the marital estate, usually in community property states, including property owned prior to the marriage and may include inheritance or gifts received during marriage. In Massachusetts, all property is marital property.
Property is not considered part of the marital estate. Usually occurring in community property states, it includes property brought into the marriage and also may include inheritance or gifts received during the marriage.
